86-year-old Male Falls in Nursing Home Due to Failure to Provide Floor Mats for Fall Protection

M-86 was admitted to a Chicagoland Nursing Home for post-acute care and rehabilitation following open reduction internal fixation (“ORIF”) of his left intertrochanteric hip fracture. He was characterized as a “fall risk” and has a history of major neurocognitive disorder, delirium, and dementia. Orders from the nursing home physician required the facility to provide both a “bed pad alarm” and “chair pad alarm” for fall prevention, as well as a “low bed with floor mats for fall prevention”. On April 16, 2018, at approximately 4:45 a.m., M-86 fell in his room and sustained, inter alia, a 1-inch laceration on his forehead. Post-incident x-rays demonstrated potential issue with hardware and revision surgery performed.
