Defendant rear-ended the vehicle containing the M-30 plaintiff on August 14, 2011, at approximately 5:30 a.m., at or near the intersection of West Addition Street and North Rockwell Street in Chicago. Plaintiff was a front-seat passenger in a vehicle that was stopped at the time of the accident. Following this incident, Plaintiff sustained a worsening of his left shoulder pathology. Plaintiff had surgery performed in March 2012. NOTE: The trial court entered partial summary judgment on the issue of duty and breach.

Settlement was reached a few days before the matter was scheduled for trial.
