Lawsuit Filed by M-70 Nursing Home Resident Who Fell and Broke All Four Limbs

Rockford, IL – On July 4, 2017, M-70, who was a resident at Forest City Rehab and Nursing Center, was in the bathroom, with an aide, transferring from the toilet to the wheelchair when his legs gave out and he fell down on both knees. M-70 sustained an open fracture of the proximal end of the right to tibia and fibula of the right leg, a closed fracture of the proximal end of his tibia/fibula of the left leg, a closed supracondylar fracture of left humerus (upper arm by elbow), and a closed supracondylar fracture of the right humerus (upper arm by elbow). Despite the fact that the defendant was aware that M-70 required extensive assistance of two (2) persons for transfers, and was not steady moving on and off the toilet (only able to stabilize with staff assist), the defendant to failed to assist him in a safe manner by not using a gait belt and/or two (2) persons.
